The tsunami many have feared is approaching. Sandra Day O'Connor is retiring. Bush will have to nominate the most reactionary atavism he can find to pay off his social conservative backers.

Get ready! I predict this fight will kick off a turmoil we haven't seen since the 60's!

I applaud O'Connor's resigning and wish other rickety judges would follow suit. Even the best pitchers loose their fast ball and have to hang up their kleats. Judges who can not separate their ass from a hole in the floor should be made to give it up.

Did you feel the same way about Thurgood Marshall and Justice Douglas?

Come on. Most of them are figureheads and their clerks write their opinions--there are several who have sat (and maybe a couple who are sitting) who fit this description.

I wish Marshall had held on until Clinton was elected (I think he died within days of Clinton's 1st inaugural.). But other than THAT, yeah, I think he should have taken powder too.

Yes. SCJ's are largely figureheads (as are MOST holders of high political/business office). But at least if their still lucid they might actually be able to at least discern WHAT 'figure' they're 'heading'.

Your point about the clerks doing their work is EXACTLY the reason why after a certain point they should hang up the robes. Because I do NOT believe people who were NOT appointed/confirmed to the Supreme Court should be surreptiously doing the work of foks who can't even recall what day of the week it is.
