Man allegedly runs over estranged wife

February 21, 2006

BY CHERYL L. REED Staff Reporter

An Elgin man became so enraged when he saw his estranged wife with her female lover that he shattered her car window with a golf club and then ran her over with his SUV, according to the victim's lover and her aunt.

"He said: 'Bitch, I'm going to run you over,'" recalled the girlfriend who was with Frances McCoy, 28, when she was run down in her Hoffman Estates apartment parking lot on Friday afternoon. McCoy, the mother of two children, died Sunday afternoon from her injuries.

"He jumped the curb with his car and ran over her body," said the 27-year-old girlfriend, who wants to be known only as "Chanteuse."

"Then he sped off. He didn't even know if she still had life in her."

After she was hit, McCoy sat up and talked to her girlfriend. Another witness at the apartment complex called police. McCoy was taken to Advocate Lutheran General in Park Ridge, where she died.

McCoy's husband, Martin McCoy, 31, was in police custody Monday awaiting new charges. After he allegedly ran over his estranged wife on Friday, he drove to the Elgin police station and turned himself in. He was charged with attempted murder and released on a $50,000 bond. After his wife died, Martin McCoy again turned himself in to police Monday morning.

"He knew she was with somebody; he just didn't know with whom. My niece tried to keep that part of her life a secret from him," said the victim's aunt, Denise Russell, 45, of Carpentersville.

Russell said relatives were worried for Frances McCoy because they often saw Martin McCoy parked outside her apartment. "I think it's plain rage. I think he had been stalking her for some time and I think he put two and two together," Russell said.

Russell said Frances and Martin McCoy had become active in an Elgin church before they separated two years ago and both still attended the same church. Frances McCoy sent her aunt and other friends a Bible verse every day.

'Martin, don't start something'

"She was very outgoing," said Russell. "As young as she was, she acted like she was everybody's mom. Whatever problem you had, she took it upon herself to fix it."

Russell said Frances McCoy's children are staying with Frances McCoy's brother in Batavia.

Chanteuse also described Frances as religious. She said she and Frances read the Bible every night and prayed together.

The two women left their apartment on Friday afternoon to get something to eat before picking up McCoy's children from day care. Frances McCoy and Martin McCoy have two children, a daughter, 7, and a son who is 10.

Chanteuse said she spotted Martin McCoy's burgundy GMC Jimmy in the parking lot and alerted Frances. Martin McCoy sped off and then quickly returned and parked behind Frances' car, she said. Then he got out and approached Frances, who was standing next to the car, according to Chanteuse.

"He said -- 'Is this your girlfriend?'" Chanteuse remembered. "She was like: 'Martin, don't start something.' That's when he hit the window with the golf club."

"Each day since the accident, I keep seeing the car running over her," Chanteuse said. "I keep thinking why. I try to come up with a logical answer. I can't find one."

Wives Also Kill Husbands--Quite Often
by Alan M. Dershowitz
Though O.J. Simpson vehemently denies that he murdered his former wife, his case has provoked a flurry of media attention toward other husbands who kill their wives. Coincidentally with the Simpson case, the Department of Justice has just released the first detailed empirical study of "murder in families." It contains some surprising information, which contrasts sharply with the media headlines.

The most shocking finding of this study--which analyzed nearly ten thousand cases--is that wives murder their husbands far more frequently than press reports would suggest. To put the issue in context, women in general account for only about 10 percent of defendants charged with all murders. But for all spousal murders, women accounted for more than 40 percent of defendants. And "among black marital partners, wives were just about as likely to kill their husbands as husbands were to kill their wives." Not surprisingly, when it comes to parents who kill their children, mothers kill more often than fathers.

The real headline of this report, therefore, is that women W almost as often as men do in the context of all family murders, though men much more often kill strangers--nearly always other men,

The other shocker in this report is that husbands who kill their wives are not treated more leniently than men who kill strangers, despite the media myth to the contrary. Indeed, they were as likely to be charged with first-degree murder, were no more likely to have their cases dismissed or diverted, and were as likely to be convicted. Nor were their sentences significantly different, when relevant "case characteristics"--such as prior criminal record--were taken into account. Indeed, the only real difference is that spousal murderers "required less time to disposition than other types of murder cases."

Despite this hard data, the myths persist that spousal murders consist almost exclusively of husbands who kill their wives and are then treated leniently by the criminal-justice system. Indeed, there is one figure that is strikingly missing from this otherwise thorough report: namely, whether women who murder their husbands are treated more leniently than husbands who murder their wives. I phoned the author of the report and asked if that data was available. He told me that it was but that it had not been compiled. I asked him if he would compile it and he did, faxing me new tables that compared the outcome of prosecution based on the gender of the victim and the accused. This previously unpublished data dramatically undercuts the myth that husbands who kill their wives are treated more leniently than wives who kill their husbands. The available evidence points overwhelmingly in the opposite direction, Wives who kill their husbands were acquitted in 12.9 percent of the cases studied, while husbands who kill their wives were acquitted in only 1.4 percent of the cases. Women who were convicted of killing their husbands were sentenced to an average of six years in prison, while men received an average of seventeen years for killing their wives, Sixteen percent of female spousal killers get probation, compared to 1.6 percent for males. By almost every other measure as well, female spousal killers are treated more leniently than male spousal killers. To be sure, some of the differences may be attributable to gender-neutral factors such as prior record, provocation, or mental illness. But there is absolutely no support in this data for the claim that husbands who kill their wives are systematically treated with kid gloves by the justice system.

Despite the unexpected data produced by this justice Department study--that wives kill husbands much more frequently than media accounts suggest and that they are treated more leniently than husbands who kill--the press release issued by the justice Department to accompany the report buried this politically incorrect data under the following politically correct headline: "Wives are the most frequent victims in family murders." But even that conclusion obscures the real picture: that for all family murders--which includes killing of parents and children as well as spouses--55.5 percent of the victims were males and 44.5 percent females, and "female defendants were more likely than male defendants to have murdered a person of the opposite sex.

The Justice Department report on "murder in families" sheds important light on a subject that is being obscured by the heat of political rhetoric The new data strongly suggests that spousal murder is not primarily a male-versus-female political issue, as some radical feminists and media commentators insist. Instead, it is primarily a psychological issue of pervasive familial violence on all sides, generated by the passions of family interaction. Misdiagnosing this important psychological problem to fit into a political agenda will delay its proper treatment and cure. The problems of spousal abuse and violence are far too serious to be turned into divisive "we versus them" political or gender issues.

Well, he'll probably only get about 20 years. But he may plead temporary insanity and get away with this.

BTW, my own personal precept regarding these matters is:

"If you love someone, let them go,
if they come back, they're yours,
if they don't, run their ass down with the Benzo!"
LOL!!!

I know y'all heard about this one.

Wife who ran over husband with the Merc gets 20 years
By C. Bryson Hull
February 16 2003
The Sun-Herald http://www.smh.com.au/articles/2003/02/15/1044927854202.html

The Texas jury that found dentist Clara Harris guilty of murder for running her cheating husband over with a Mercedes-Benz sentenced her to 20 years in prison yesterday, bringing her tale of love gone sour to a close on her 11th wedding anniversary.

Harris, a 45-year-old native of Colombia and former beauty queen, sank into her chair, put her hands over face and wept after state district judge Carol Davies read the jury's decision, reached after six hours' deliberation.

Three of the nine women on the 12-person jury also cried, as did Harris's 17-year-old stepdaughter Lindsey Harris, whose dramatic testimony was the key to the prosecution's case.

Clara Harris could have been jailed for up to 99 years but the jury found she had acted in "sudden passion", which put the maximum at 20 years.

The mother of four-year-old twin boys will not be eligible for parole until she has served 10 years.

Harris ran over orthodontist David Harris, 44, on July 24 last year in the parking lot of a Houston-area hotel where he had gone with girlfriend Gail Bridges. She claimed it was an accident but prosecutors said it was intentional.

Lindsey Harris told the court how she had witnessed her father's death from the passenger seat of the Mercedes. Her stepmother had clearly intended to run over her father, she said.

According to testimony in the three-week-long trial, the Harrises were happily married and running their lucrative dental practices until early last year. That is when David Harris began an affair with Ms Bridges, his office receptionist.

He agreed to stop seeing her after eliciting promises that his wife would lose weight and get breast implants. He told her he would break up with Ms Bridges over dinner on July 24.

But a suspicious Clara Harris found her husband and his lover at a hotel that night, striding out of the elevator, holding hands and smiling. Enraged, Harris charged in swinging at and striking Ms Bridges until her husband, a martial arts enthusiast, threw her to the ground.

After the brawl, David Harris told his wife their marriage was "over" and left to escort Ms Bridges toher truck. That was when Clara Harris, accompanied by her stepdaughter, wheeled her Mercedes towards her husband and ran him down, prosecutors said.

Lindsey Harris has filed a wrongful death case against her stepmother.

After her father's death, Lindsey said, her school grades dropped and her interest in cheerleading evaporated. She broke up with her boyfriend and is estranged from her grandparents - David Harris's parents - "because they forgave Clara for what she did".

"I don't know why they're doing this to my poor dad," she said.

Lindsey testified that in the weeks following the murder, the numbness slowly turned to depression. She sought help from a counsellor and medication but it was all too much.

"I tried to slit my wrists, more than once," she said. At this, Clara Harris took a sharp breath and began to cry.

"I'm sorry, I'm sorry, Lindsey," she called out, standing as the weeping teenager and jurors were led from the courtroom.

Harris has cried throughout the trial, annoying prosecutors who claimed it was a bid for juror sympathy. Denying a prosecution motion to remove Harris from the courtroom for this latest outburst, Judge Davies told the red-eyed Harris: "I will give you one last chance. Don't blow it or you will be out of this courtroom."

"Thank you, your honour," Harris said softly.

Gerald Harris, David's father, took the stand on Thursday to explain why he still supports his daughter-in-law. He denied Lindsey's contention that his son's multimillion-dollar estate was the motivating force.

"This tragedy was a very strong blow against our family," said Mr Harris, a former high school principal. "But God forgave us for our sins. We feel like a member of our family has erred and that we should forgive that."

"She is a member of my family and I would not turn away from her," he said.

I don't understand how people compromise their freedom just to "get back" at a man (or woman) when there are so many other potential mates in the world.

MoonSigns - Obviously when you're at the point of running someone over with your vehicle, you probably aren't thinking very clearly. When you go ballistic, the lights go out, you develop tunnel vision, and all you want to do is whoop ass, stab a MF, burn them, shoot them, run them over with the Benzo, or otherwise cause them pain or emotional distress. You're not thinking about being hand-cuffed in the backseat of a police cruiser, your mama's feelings, what your children's little friends are going to say, sitting before a jury of your peers, prison time, the crappy food that is served in prison, the death penalty, or none of that. Have you never gone ballistic on somebody?

Moonsigns you are from the moon. The last damn thing a man or a woman infuriated in the throes of jealousy thinks about is what is going to happen to them afterward.

Afterward they are often sorry and contrite. In fact there are many cases on file of crazed lovers who murdered their lovers who had not committed a criminal offense in their lives before.

I knew such a guy--sang in the church choir. Meek and mild. Would not hurt a mouse. Wife said she was leaving him. He shot her and drove around screaming and crying with her in the car as she bled to death. Finally he ran up to a cop and told her what he had done--too late.

I'd like to see you, Moon if you walked in on your man in bed with another woman or man and you had that .45 or that butcher knife in your hand...

Chris,

No one can truly say what they would do in any given situation, however, it's not in my nature to lose control like that and be the "jealous type"--especially when it comes to a man. My thinking is this, why harm a man when he can pay you for the rest of your life for his foolishness?

Mzuri,

No need to "go there". It's just that you may go ballistic in a different way than me and vice versa.

To answer your question, yes, I've gone ballistic before--become extremely upset and angry, but I've never gotten "WILD"--punching, kicking, hitting, screaming at the top of my lungs etc.

Obviously, Chris, when I use the word "pay" I'm referring to financial compensation. I think it would be torture for a man to have to watch a majority of his money go to his ex because he can't control himself sexually.

MoonSigns - I didn't go "there." I'm using plain, mainstream good old American (and yes, we speaketh American English, not English English) and I pride myself in being well-read and well-spoken. I'm sure that you can detect from my writing that I'm not a bimbo and so therefore you don't need to question my words, their meaning or their intent.

When someone posts a word that you do not understand, you should simply go to either of the websites I posted (or your bookshelf) and look it up so that you will be informed. (Just like I did a while ago when Kola used the word "beard" in reference to Luther Vandross and Lisa Fisher and that was my new vocabulary word of the day. Instead of asking Kola to elaborate, define, and explain what it meant or how she meant it - like I don't have a brain.)

Then, if something is still unclear, you can question the poster. Instead of asking ppl to define commonly used words that we should all know the definition of - because you think that something might have a different meaning to you than it does to them. What is that about anyway?

Besides all of that, I explained what the heck ballistic was within the post itself. I wrote - When you go ballistic, the lights go out, you develop tunnel vision, and all you want to do is whoop ass, stab a MF, burn them, shoot them, run them over with the Benzo, or otherwise cause them pain or emotional distress.

And my final thought on this matter - that old proverb about the only dumb question being the question you don't ask - I totally disagree, because a person can ask a stupid question. Even worse, why you feel that anyone should explain elementary things to you is beyond me. But I did and there you have it.
